The Volunteer does hereby freely, voluntarily, and without duress execute this Release under the following terms:
1. Waivers and Release. Volunteer does hereby release and forever discharge and hold harmless Nourish and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer's work with Nourish. Volunteer understands that this release discharges Nourish from any liability or claim that the Volunteer or Guardian may have against Nourish with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Volunteer's work with Nourish, whether caused by the negligence of Nourish or its officers, directors, employees, agents or otherwise. Volunteer also understands that Nourish does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness. It is the policy of Nourish that minors are required to have a waiver and release signed by his or her legal guardian.
2. Medical Treatment. Volunteer does hereby release and forever discharge Nourish from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer's work with Nourish.
3. Assumption of the Risk. The Volunteer understands that the work for Nourish may include activities that may be hazardous to the Volunteer, including, but not limited to: use of kitchen knives, stove, or slicers, gardening tools, office equipment, lifting of objects, use of stairs and elevator. Volunteer hereby expressly and specifically assumes the risk of injury or harm in these activities and releases Nourish from all liability for injury, illness, death, or property damage resulting from the activities of the Volunteer’s work for Nourish.
4. Insurance. The Volunteer understands that, except as otherwise agreed to by Nourish in writing, Nourish does not carry or maintain health, medical, or disability insurance coverage for any Volunteer.
5. Photographic Release. Volunteer does hereby grant and convey unto Nourish all right, title, and interest in any and all photographic images and video or audio recordings during the Volunteer’s work for Nourish, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
6. Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State, and that this Release shall be governed by and interpreted in accordance with the laws of the State. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
Confidentiality Pledge: As a Volunteer with Nourish, I have been instructed on the policy of confidentiality as it pertains to Nourish organizational or donor data and in regards to the clients and/or residents of sites Nourish works with such as The Salvation Army, Safe Harbor, and any other homeless shelter or church used in conjunction with Nourish Volunteer opportunities. I fully understand this policy as explained and outlined below: I will treat all information, written and verbal, regarding donor relationships and internal data with confidentiality unless specified as public information.
I will treat all information, both written and verbal, about individuals using the services of the above-listed organizations and Nourish with respect for their dignity and right to privacy. I will not now or in the future, reveal anything considered to be confidential (including but not limited to, the identity and/or location of stated clients and/or residents), that I have seen or heard while volunteering, to anyone outside of Nourish. I will not acknowledge in public how or where I made initial contact with any clients and/or residents. I understand that this confidentiality policy is meant to protect the clients and/or residents of these agencies in addition to preserving dignity.
